Harborview Fellowship (“we,” “us,” or “our”) respects your privacy and your safety. This document explains who we are, how we collect, use, and share personal information about you, and the terms under which you may access and use our website (the “Site”).

Important: By accessing or using this Site, you agree to be bound by both this Privacy Policy and the Terms of Use and Liability Waivers contained herein. If you do not agree to these terms, please do not use the Site.

What does Harborview Fellowship do?

Harborview Fellowship is a non-profit religious organization headquartered in Gig Harbor, Washington. Our mission is to serve our community through ministry, fellowship, and outreach.

The personal information that we collect about you through the Site depends on how you interact with us:

  • Information that you provide voluntarily: We collect certain personal information from you when you choose to provide it on or through our Site, including but not limited to your first and last name, address, email address, phone number, and payment information (processed securely by Pushpay).
  • Information that we collect automatically: The Site may collect certain information automatically from your device when you visit, such as your IP address, browser type, operating system, and referring URLs. We may also collect information about how your device interacts with the Site, including pages accessed and links clicked. We use and process your personal information for the following purposes:

  • To deliver and improve our services: To connect with you directly and provide services related to our mission effectively.
  • To send communications: To communicate about our organization, services, community news, promotions, or events.

We strongly recommend that you use encryption appropriate to the nature of your communications where possible. We may, at our sole discretion, cooperate with legal authorities in the investigation of any suspected or alleged crime or civil wrong.

Data Retention

We retain your personal information for as long as we require it for the purposes set out in this policy or as required by applicable laws (e.g., tax or accounting requirements).

Your Data Protection Rights and Right to Deletion

You have the right to request that Harborview Fellowship delete the personal information we have collected from you.

  • How to Request: To submit a deletion request, please contact us at admin@hfcgh.org with the subject line “Data Deletion Request.” You must include your full name and the email address associated with your account.
  • Verification: We may need to verify your identity before processing your request to prevent unauthorized deletion.
  • Exceptions: Please note that we may not be able to delete your information if:
    • We are required by law to retain it (e.g., financial records for tax purposes).
    • The data is necessary to complete a transaction you requested (e.g., an active donation record).
    • The data is required to exercise our legal rights, specifically to defend against claims or enforce the Liability Release and Indemnity Agreement sections of this policy.
  • Effect of Deletion: If you request deletion, you may lose access to certain features of the Site, such as giving history or saved preferences. However, your agreement to the Liability Release and Indemnity Agreement sections of this policy remains in effect for past activities, as these are legal obligations that survive the deletion of personal data.

TERMS OF USE AND LIABILITY WAIVERS

The following sections contain critical legal agreements regarding your use of the Site and our facilities. By using the Site, you agree to these terms.

1. Acceptable Use and Content Restrictions

Since internet bandwidth and server resources are shared commodities critical to our operations, you agree to limit your use of the Site to web browsing, social media interaction, music/video streaming, and basic communication.

  • Prohibited Content: You agree not to upload, download, post, email, transmit, or make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights.
  • Discretionary Blocking: Harborview Fellowship reserves the right to remove, block, filter, or restrict any site or content that, in our sole discretion, may be illegal, subject us to liability, threaten the security of our systems, or is incompatible with our bylaws, Statement of Faith, and Christian ethos.
  • Equipment Responsibility: You agree to provide all equipment (including computer hardware and software) to access the Site. You are responsible for all communications you send or receive via the Site.

2. No Warranty of Security

Harborview Fellowship does not undertake nor warrant the security of data you send through the Site. You agree that Harborview Fellowship is not liable for any action or inaction arising out of your use of the Site. We strongly recommend that you use encryption appropriate to the nature of your communications. We may, at our sole discretion, cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.

3. Assumption of Risk and Liability Release

You acknowledge that participation in Harborview Fellowship activities, including but not limited to the use of our facilities (indoor rock walls, playgrounds, court sports, stairways, sidewalks, parking lots), involves inherent risks that may result in injury, illness, or damage.

  • Acceptance of Risk: You hereby accept these risks and agree to use the Site and our facilities at your own risk.
  • Release: You hereby release and hold harmless Harborview Fellowship, its staff, agents, directors, and volunteers from any damages, liability, or loss resulting from your participation in our ministry activities or use of our facilities.

4. Parental Release for Minor Children

If you are a parent or guardian of a minor child:

  • Medical Consent: In the event your child requires medical attention and you cannot be contacted, you grant permission to a licensed health care provider or accredited hospital to perform any essential medical or surgical procedures. You agree to be responsible for payment for such care.
  • Activity Release: You release and hold harmless Harborview Fellowship, its staff, and agents from any damages, liability, or loss resulting from your child’s participation in Children’s Ministry and activities, including any injuries sustained.

5. Media and Photo Permission

By using the Site and attending our events, you grant Harborview Fellowship permission to take photographs, video recordings, or conduct live-streaming of you and your family members.

  • Usage: These materials may be used for slide shows, videos for church programs, ministry promotion, live streaming, transmission on social media, and on our website.
  • Consent: This consent applies to all ministry activities and events associated with Harborview Fellowship.
  • Restriction on Premises: Please note that video recording on the physical premises of Harborview Fellowship is prohibited unless you receive written permission by an officer of Harborview Fellowship. This restriction applies to visitors physically present at our location.

6. Indemnity Agreement

In consideration for the use of the Site and Harborview Fellowship’s services (provided at no charge or as part of our ministry), you agree to indemnify and hold harmless Harborview Fellowship, its staff, agents, directors, members, officers, volunteers, vendors, contractors, and insurers from any and all claims, actions, liabilities, losses, damages, suits, expenses (including reasonable legal fees), and judgments arising out of:

  • Your acts or omissions in connection with activities on our premises;
  • Any accident, injury, or death to persons;
  • Loss of or damage to property;
  • Fines or penalties resulting from your actions while on our premises or using our Site.

Note: This obligation lasts in perpetuity. This agreement includes claims related to infectious diseases (including but not limited to Covid-19), whether past, present, or future.

7. Voluntary Agreement

By accepting these terms, you acknowledge that this Agreement is voluntary, given without coercion or duress, and that you have carefully read and fully understand all provisions, including those relating to unknown claims. You confirm that you accept this Agreement only after full reflection and analysis.

8. Miscellaneous

  • Severability: If any provision of this Agreement is held invalid, the remaining provisions will continue to be valid and enforceable.
  • Governing Law: This Agreement shall be construed and performed under the laws of the State of Washington.
  • Waiver: Failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Updates to This Policy

We may update this Privacy Policy and Terms of Use from time to time. Changes are effective upon publication. Continued use of the Site constitutes acceptance of the updated terms.
